Muslims to NY attorney general: Investigate NYPD (AP)

Police Commissioner Raymond Kelly and Mayor Michael Bloomberg have insisted that police only follow legitimate leads and do not conduct preventative surveillance in ethnic communities. A May 2006 report addressed to Kelly, however, recommended increased spying at mosques and an assessment of the region's Palestinian community to look for potential terrorists.

Even before the AP published the document, Kelly was under fire from Muslim groups who were angry that a controversial movie about Muslims, "The Third Jihad," was shown at NYPD training sessions. Kelly appears briefly in the movie.

About 150 protesters gathered near police headquarters Friday to challenge the NYPD's tactics.

"Just the fact of knowing there is someone out there trying to listen to my conversations that can turn me into some kind of criminal, which I'm not, and exploiting my religion, it hurts," said Sondos Alsilwi, an 18-year-old history major at City College.

Schneiderman's office did not immediately have a comment on the letter.

The Obama administration has made fighting homegrown terrorism a focus of its national security strategy but has repeatedly sidestepped questions about whether it endorses the NYPD's tactics. Tom Perez, the U.S. Justice Department's top civil rights prosecutor, has refused to even answer questions about the NYPD.

The 2006 intelligence report, entitled "US-Iran Conflict: The Threat to New York City," made a series of recommendations to Kelly, including: "Expand and focus intelligence collections at Shi'a mosques." It includes a list of mosques and community organizations stretching from southern New Jersey to Connecticut.

The NYPD's operating rules prohibit it from basing investigations on religion. The NYPD also says it follows FBI guidelines, which would prohibit many of the steps recommended in the report.

But the NYPD faces little in the way of oversight when it comes to its intelligence programs. Both the City Council and Congress are kept in the dark about this secretive aspect of the department. Many first learned about the spying programs from news reports.

"The masses of people around this city are fed up with the police," City Councilman Charles Barron told protesters Friday. "Who the hell do they think they are?"

On Thursday, Kelly downplayed the significance of the 2006 document, calling it a "contingency plan" for military conflict between the U.S. and Iran. Such language does not exist anywhere in the document.

Fears of such a conflict were rising again Friday amid concerns in the Middle East that Israel was preparing a military strike on Iran. Iran's supreme leader Ayatollah Ali Khamenei warned that an attack would only hurt the United States.

"A war itself will damage the U.S. 10 times over" in the region, "Khamenei said in a national broadcast Friday.

Iran is a majority Shi'a country, while most Muslims belong to the Sunni sect.

In August, when the AP first reported on the spying operations, Bloomberg said the NYPD doesn't even consider religion as part of its police work.

"We don't stop to think about the religion," he said. "We think about the threats and focus our efforts there."

Bloomberg spokesman Marc LaVorgna would not say whether the mayor still believes that.

Police: Suspect in 4 Calif. homeless men linked to 2 more deaths

Itzcoatl Ocampo, 23, who was caught Jan. 13 in Anaheim, Calif., and charged with killing four homeless men, is linked to two other slayings, police said Thursday.

ANAHEIM, Calif. -- An ex-Marine charged with killing four homeless men in Southern California has been linked to the stabbing deaths of a woman and her son,?police said Thursday at a news conference.

Itzcoatl Ocampo, 23, has been connected with?Eder Herrera,?the suspect in the Orange County stabbings in October,?said Anaheim Lt. Julia Harvey of the Homeless Homicide Taskforce.

Police would not comment on the connection between Ocampo and Herrera, but based on the location of the crime, the proximity to his residence and the modus operandi (MO), they are linking the two incidents previously thought to be separate, Harvey said.


Raquel Estrada and her son Juan Herrera were killed in October in Yorba Linda, less than two miles from Ocampo's home. Eder Herrera is Raquel Estrada's 24-year-old son and was arrested soon after the two killings.

Ocampo, an Iraq War veteran, was arrested Jan. 13 and charged with the murders of four homeless men in Orange County, including Anaheim, Placentia and Yorba Linda.

Police at the time said they were "extremely confident" that they had taken into custody the man responsible for the slayings.

Warrants: Man held in homeless killings said he stalked victim

Shortly after his arrest, prosecutors said they would consider seeking the death penalty against him.

"In each of these cases, the violence, the number of stab wounds increased," Orange County?District Attorney Tony Rackauckas told NBCLA.

Authorities say?Ocampo's?killing spree targeted James Patrick McGillivray, 53, who was stabbed Dec. 20 near a shopping center in Placentia; Lloyd Middaugh, 42, who was found Dec. 28 near a riverbed trail in Anaheim; Paulus Smit, 57, who was stabbed to death outside a Yorba Linda library on Dec. 30; and John Berry, 64, who was stabbed to death on the day Ocampo was arrested.

Each of the four men was stabbed more than 40 times with a weapon believed to be a 7-inch fixed-blade military-type knife, authorities said.

Before Ocampo's Jan. 13 arrest, police had fanned out across the county better known as the home to Disneyland and multimillion-dollar beachfront homes to urge the homeless to be careful and seek shelter indoors.

An arraignment for Ocampo scheduled for Jan. 18 was postponed to?Feb. 17. He remains jailed without bail, NBCLA said.

A violent stomach virus outbreak has forced St. Ignatius High School, a Jesuit college preparatory academy in the Sunset district, to shut down through the weekend.

Principal Patrick Ruff said in a news conference that more than 300 students (over 20 percent of the student body) and 30 teachers became ill from gastroenteritis, causing many to vomit in trash cans across the campus.

Ruff explained that the number of absent teachers would make it difficult to hold classes. Peter Radsliffe, whose son was among the sickened, told Bay City News the virus already appeared to have cleared up. "He felt much better this morning," Radsliffe said. "He's sleeping, feeling fine, just the typical 24-hour bug that you get over."

St. Ignatius boasts a number of famous alumni, including California Governor Jerry Brown, former San Francisco Mayor George Moscone, Gordon Getty and Intel CEO Peter Otellini.

Humpbacks share ocean, but not their songs

Humpback whales living on different sides of the southern Indian Ocean bellow very different songs, suggesting the behemoths don't mingle much, or at least they aren't freely sharing their musical material, a new study finds.

Among humpback whales (Megaptera novaeangliae), males are the typical crooners, singing their tunes at a population's winter breeding grounds, along migration routes and at summer feeding grounds. The songs consist of complex arrangements of so-called themes, which are mixes of wails, moans and shrieks that get repeated in cycles lasting up to 30 minutes, according to the researchers.

Like disc jockeys fading out one song while starting another, humpback whales also transition between song themes; these transitional "phrases" combine bits from both the preceding and subsequent themes. (A past mathematical analysis revealed just how complex these songs are, using grammatical rules to string together hours-long melodies.)

While past research has suggested humpbacks sharing the same ocean basin also share similar songs, the new study suggests that's not the case for the two populations on both sides of the southern Indian Ocean.

The scientists used hydrophones to record humpback whale songs from 19 individuals in two spots along the coast of Madagascar and three areas along Western Australia during the 2006 breeding season. The team captured more than 20 hours of whale song (either whole song cycles or fragments of songs). Their analysis revealed a total of 11 different themes in both regions, with just one theme shared by both populations.

"Songs from Madagascar and Western Australia only shared one similar theme, the rest of the themes were completely different," said lead author Anita Murray, who conducted the research while a graduate student at Columbia University and the Wildlife Conservation Society.

Murray and colleagues say the reason for the song anomaly is a mystery.

"It could be the influence of singing whales from other ocean basins, such as the South Pacific or Atlantic, indicating an exchange of individuals between oceans which is unique to the Southern Hemisphere," said Murray, who is currently a doctoral student at the University of Queensland in Australia.

The researchers note the findings are limited by the fact that they are based on just one breeding season, and further research is needed to elucidate the reasons behind the whales' distinct songs.

As for why the two populations share one song, the researchers speculate that "some number of males from Madagascar and Western Australia could potentially be in acoustic contact during the feeding season and during this contact cultural transmission in song content would occur," they write in the journal article.
